1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Creative Coders Consortium ("we", "our", or "us") governing your access to and use of our website and services.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access our services.

2. Description of Services

Creative Coders Consortium provides custom coding and development services for college students, including but not limited to:

  • Web application development
  • Database system implementation
  • AI and machine learning solutions
  • Data science projects
  • Technical documentation

3. Use of Services

Eligibility

You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Account Responsibility

If you create an account with us, you are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our services. You also agree not to attempt to gain unauthorized access to any part of our services, other accounts, or computer systems or networks connected to our services.

4. Project Delivery and Acceptance

Project Requirements

You are responsible for providing clear and complete project requirements. We will develop the project based on the requirements you provide. Any changes to the requirements after the project has begun may result in additional charges and extended delivery timelines.

Delivery Timeline

We will make reasonable efforts to deliver the project within the agreed-upon timeline. However, delivery dates are estimates and not guarantees. Delays may occur due to various factors, including but not limited to changes in project requirements, technical challenges, or communication delays.

Project Acceptance

Upon delivery of the project, you will have a specified period (typically 7 days) to review the project and request revisions. If you do not request revisions within this period, the project will be deemed accepted.

5. Payment Terms

Pricing

Our pricing is based on the complexity, scope, and timeline of the project. We will provide you with a quote before beginning work on your project.

Payment Schedule

Unless otherwise agreed, payment terms are as follows:

  • 50% of the total project cost is due as a non-refundable deposit before work begins
  • The remaining 50% is due upon project completion and before final delivery

Late Payments

Late payments may result in work stoppage and delay in project delivery. We reserve the right to charge a late fee of 1.5% per month on overdue amounts.

6. Intellectual Property Rights

Ownership of Deliverables

Upon full payment, you will own the deliverables created specifically for your project. However, we retain ownership of any pre-existing materials, tools, frameworks, or methodologies used in the development of your project.

License to Use

We grant you a non-exclusive, worldwide, perpetual license to use, modify, and distribute the deliverables for your personal or educational purposes.

Portfolio Rights

We reserve the right to display and link to your project as part of our portfolio and to write about the project on websites, in articles, and in books about web design.

7. Confidentiality

We agree to keep confidential any proprietary information shared with us during the course of the project. Similarly, you agree to keep confidential any proprietary information we share with you.

8. Academic Integrity

Our services are intended to assist you with your academic projects. You are responsible for ensuring that your use of our services complies with your institution's academic integrity policies. We do not condone plagiarism or academic dishonesty.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our services
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services

10. Indemnification

You agree to defend, indemnify, and hold harmless Creative Coders Consortium and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of our services or your violation of these Terms.

11. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Creative Coders Consortium is registered, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
